These Terms & Conditions (“Terms”) govern your use of our website NitroTechElectric.ca (the “Site”) and your purchase or receipt of our electrical contracting services (the “Services”). By accessing the Site, requesting a quote, placing a work order, or permitting us to perform Services, you agree to these Terms.


1) Who we are

NitroTech Electric Systems Inc. is an Ontario-based electrical contractor providing residential, commercial, and light industrial electrical services. Our Site provides information and a means to request quotes, schedule appointments, and contact us.


2) Eligibility & accountless use

The Site is provided for use in Canada. You must be at least the age of majority in your province/territory to enter into a contract for Services. We do not require an account to submit inquiries; where we provide any login or portal access, you are responsible for safeguarding your credentials and for all activity under them.


3) Quotes, estimates & scope

  • Estimates. Any quote, estimate, or proposal we issue (collectively, “Estimate”) describes the scope, assumptions, exclusions, materials, and price. Estimates are not binding until accepted in writing (including email/SMS acceptance) and scheduling is confirmed.
  • Validity. Unless otherwise stated, Estimates are valid for 30 calendar days and subject to material availability and market pricing at the time of scheduling.
  • Site conditions. Estimates assume safe, code-compliant existing conditions and clear access. Hidden/unknown conditions (e.g., buried junctions, aluminum branch circuits, knob-and-tube, asbestos, mold, structural deficiencies) may require a change in scope and price.
  • Change orders. Any customer-requested changes or work required to meet code or remedy unforeseen conditions will be authorized via written change order (email/SMS approval is sufficient) and billed at the then-current rates.

4) Scheduling, access & customer responsibilities

  • Access. You must provide safe, reasonable access to the premises, panels, devices, and work areas; secure pets; and ensure an adult with authority is present.
  • Utility locates & permits. For excavation/trenching, you (or we, if engaged) must obtain utility locates (e.g., Ontario One Call). For regulated work, we will obtain the necessary Electrical Safety Authority (ESA) notification/permit when engaged to do so; related fees will be charged to you.
  • Owner-supplied materials. We are not responsible for defects or delays caused by owner-supplied materials; labour to diagnose/replace such items is billable.

5) Cancellations, rescheduling & delays

  • Customer cancellations. Please provide at least 24 hours’ notice to cancel or reschedule non-emergency appointments. Short-notice cancellations may incur a call-out or minimum labour charge to cover lost time and travel.
  • Delays. We are not responsible for delays outside our control (e.g., utility outages, parts backorders, strikes, weather, access restrictions). If a delay occurs, we will reschedule as soon as practicable.

6) Pricing, deposits, taxes & payment

  • Rates & minimums. We may charge by fixed price or time & material (T&M) with a minimum call-out. Emergency or after-hours rates may apply.
  • Deposits. We may require a deposit for special-order materials or large projects; deposits are applied to final invoices.
  • Taxes. Prices are exclusive of HST unless stated otherwise.
  • Payment terms. Invoices are due upon receipt unless otherwise stated on the invoice or work order. We accept common forms of payment (details provided on invoice).
  • Late amounts. Overdue balances may accrue interest at 1.5% per month (18% per annum) or the maximum permitted by law, whichever is lower. You agree to pay reasonable collection costs and NSF fees where applicable.

7) Warranty & workmanship

  • Workmanship. We warrant our workmanship for 1 year from substantial completion against defects arising from installation that do not result from misuse, abuse, neglect, modifications by others, or normal wear.
  • Materials. Manufacturer warranties apply to materials and devices; we will assist with claims where feasible, but decisions are the manufacturer’s. Labour to remove/reinstall warrantied materials after 1 year may be billable.
  • Exclusions. No warranty on: owner-supplied parts, pre-existing deficiencies, consumables (lamps, fuses), nuisance tripping caused by connected equipment, or network/Wi-Fi issues affecting smart devices.

8) Code compliance, permits & inspections

We perform work in accordance with the Ontario Electrical Safety Code and applicable laws. Where engaged, we will file ESA notifications/permits and coordinate inspections. If an inspection reveals additional corrective work is required to meet code, such work will be treated as a change order.


9) Safety & hazardous materials

We may refuse or suspend work if we determine conditions are unsafe (e.g., live exposed conductors, structural instability, asbestos, vermiculite, mold, rodent infestation). Abatement or remediation is the customer’s responsibility unless expressly included in our scope.


10) Customer content & testimonials

If you provide reviews, photos, or testimonials, you represent you have the right to do so and you grant us a non-exclusive right to display them on the Site and marketing materials. You may withdraw permission by written notice; we will remove materials where practical going forward.


11) Website use; informational content only

The Site provides general information and marketing content. It is not professional or technical advice. Always rely on a qualified electrician’s assessment for your specific situation. We may update, suspend, or discontinue Site content at any time.


12) Intellectual property

All Site content (text, graphics, logos, photos, layouts) is owned by us or our licensors and protected by Canadian and international IP laws. You may view and print content for personal, non-commercial use. You may not copy, modify, distribute, or make derivative works without our prior written consent.


13) Acceptable use

You agree not to: (a) misuse the Site; (b) introduce malware or attempt to gain unauthorized access; (c) scrape or harvest data; (d) infringe IP or privacy rights; or (e) use the Site for unlawful, harmful, or abusive purposes.


14) Privacy & communications

Our Privacy Policy explains how we collect, use, share, and protect personal information. By providing your phone or email, you consent to receiving service-related communications. Marketing emails/SMS are sent only with consent and always include an unsubscribe.


15) Third-party services & links

We may link to third-party sites or use third-party tools (e.g., maps, analytics, form providers). Those services have their own terms and privacy practices; we are not responsible for them. Your use of third-party services is at your own risk.


16) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT). We do not warrant uninterrupted or error-free operation of the Site.


17) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR SERVICES.
FOR SERVICES PERFORMED, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC WORK GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT, UNLESS A DIFFERENT LIMIT IS REQUIRED BY APPLICABLE LAW. These limits do not apply to liability that cannot be excluded under law.


18) Indemnity

You agree to indemnify and hold harmless NitroTech and our directors, officers, employees, and contractors from claims, losses, and expenses (including reasonable legal fees) arising out of: (a) your misuse of the Site; (b) your breach of these Terms; or (c) materials you provide that infringe others’ rights or violate law.


19) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, extreme weather, utility/provider outages, strikes, pandemics, supply-chain failures, or government actions.


20) Subcontractors & assignment

We may use vetted subcontractors and suppliers to perform portions of the Services. We may assign our rights/obligations under these Terms in connection with a business reorganization or sale. You may not assign your rights without our written consent.


21) Governing law; disputes

These Terms and any Services are governed by the laws of the Province of Ontario and applicable federal laws of Canada, without regard to conflicts rules.
Dispute process. If a dispute arises, the parties will first attempt to resolve it in good faith within 30 days. If unresolved, either party may seek remedies in the courts of Ontario (and the Small Claims Court where appropriate). You agree to the exclusive jurisdiction and venue of those courts.


22) Severability; waiver; entire agreement

If any provision is found invalid or unenforceable, the remainder remains in effect. Our failure to enforce a right is not a waiver. These Terms, together with any signed Estimate/work order and our Privacy Policy, form the entire agreement regarding the Site and Services.


23) Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new “Effective date.” Material changes will be highlighted for a reasonable period. Continued use of the Site or Services after changes constitutes acceptance.
